Zoning

Knowledge of zoning laws plays a significant role in real estate development. The state of Florida requires that all cities and counties ensure land development meets the standards set by governmental entities and follow principles and procedures laid out in a Comprehensive Growth Management Plan. The Comprehensive Plan includes a Future Land Use Map, which is similar to a zoning map in that it defines usage, density, such as the number of residences allowed within a certain area; and determines whether sufficient land has been allocated for future needs. Development plans must meet all zoning code requirements and be submitted for development review and approval. Zoning areas are categorized as residential, commercial, agricultural, or industrial and restrict the size and height of buildings as well as building location on the lot. Additionally, environmental regulations must be met regarding docks, wetlands and shoreline protection. Our real estate attorneys have years of experience in dealing with zoning and land use issues.
